Qualy User Agreement & Disclaimer

1. Acceptance of Terms

By signing up for and using Qualy (our platform), you acknowledge and agree to the terms outlined in this agreement. Failure to comply with these terms may result in account suspension, permanent bans, or removal of content.

2. General Use & Liability Waiver

Qualy Time Attack is an online motorsports platform that provides a method of competition for track drivers, a virtual garage, interaction with other drivers, and other additional features as they are developed.

Qualy Time Attack is an asynchronous, results-based competition — not an on-track contest.

You acknowledge that driving on track is inherently dangerous. Qualy is not responsible for any injuries, damages, mechanical failures, accidents, legal issues, or any outcomes that occur related to you, your car, or any activities you choose to engage in.

You acknowledge that you will strictly adhere to the rules of the organizing body for the event you are attending. This includes not driving in an unsafe or unpredictable manner, giving point-bys to faster cars behind you, only passing cars that give you the appropriate signal, and making sure you have adequate space to do your lap.

Traffic is considered a normal and unavoidable element of on-track driving. Drivers must never pressure, signal, or otherwise attempt to influence other drivers for competitive advantage.

Qualy does not alter the on-track rules, conduct standards, or passing mechanics of any event. Our platform operates entirely downstream of the driving activity and rejects laps achieved through unsafe or coercive behavior.

Qualy reserves the right to review submitted video for unsafe conduct, including but not limited to passing pressure, tailgating, or violation of event rules. Laps set with unsafe behavior will be rejected regardless of lap time.

You are solely responsible for ensuring that any modifications, track participation, or driving activities comply with applicable laws, safety standards, and event regulations.

You agree not to hold Qualy, its owners, partners, affiliates, clubs, or sponsors liable for any harm, damage, or loss resulting from your use of the platform.

3. User Conduct & Community Guidelines

To maintain a fair and engaging community, you agree to:

• Be honest and transparent in all activities, including lap time submissions, vehicle information, classing, and event participation.
• Respect other users — no harassment, hate speech, spamming, or disruptive behavior.
• Not misuse the platform, including any attempt to manipulate rankings, cheat the system, or engage in fraudulent activity.
• Any attempt to induce, pressure, or coerce another driver into providing a point-by or altering their driving behavior constitutes unsportsmanlike conduct and may result in lap disqualification or account ban.
• Follow all rules and regulations set forth by our platform.

Please see the Code of Fair Competition for further details. Failure to follow these guidelines may result in content removal, account suspension, or permanent ban.

4. Website Features & Future Services

Qualy is not just an online time attack platform. It includes:

• A Virtual Garage for tracking and sharing vehicles.
• A Lap Submission System with user notifications.
• A leaderboard for all-time records that have been submitted on Qualy.
• Future features to come.

Future features may have separate terms and conditions. Qualy reserves the right to modify, add, or remove features at any time.

5. User Data & Privacy

By using the Platform, you acknowledge and agree that any data, content, telemetry, submissions, or materials you provide (including but not limited to lap data, video links, vehicle information, and usage data) may be collected, stored, processed, and used by Qualy Time Attack and its operators for any lawful business purpose.

Such data may be shared with third parties in accordance with applicable law.

By submitting content to the Platform, you grant Qualy Time Attack a non-exclusive, worldwide, royalty-free license to display and use such content as necessary to operate the Platform.

While reasonable measures are taken to protect user data, we do not guarantee absolute security or confidentiality, and users should avoid submitting sensitive information.

6. No Warranty & Limitation of Liability

• Qualy provides all content, services, and tools "as is" without any guarantees of accuracy, availability, or reliability.
• We are not responsible for lost data, account issues, disputes between users, or site downtime.
• Any financial transactions are non-refundable are solely the responsibility of the user.
• Qualy is not liable for any damages, losses, or legal claims arising from your use of the platform.

7. Changes to This Agreement

Qualy reserves the right to update, modify, or change this agreement at any time. Continued use of the platform constitutes acceptance of any new terms.

By signing up on Qualy, you acknowledge that you have read, understood, and agree to these terms.

8. Accessibility & Disability Disclaimer

Qualy will make a best efforts attempt to ensure our platform is accessible to all users, including those with disabilities. We strive to comply with applicable accessibility laws and regulations to ensure that users with disabilities can fully participate in and enjoy the platform's features.

While we aim to provide an inclusive experience, we acknowledge that some aspects of the platform may not be fully optimized for all disabilities. If you encounter any accessibility issues or have specific needs, please contact us at info@qualytimeattack.com.

You agree that, by using the platform, you understand that limitations exist regarding accessibility features, including from those due to the nature of driving and release Qualy from any liability related to those limitations.

9. Club Disclaimer

Clubs featured on Qualy Time Attack are independent third parties and are not owned, operated, or managed by Qualy Time Attack or Project DRS, LLC.

All existing Qualy terms, including the General Disclaimer, Rules & Safety Guidelines, Code of Fair Competition, and Lap Submission Requirements, continue to apply in full to all Club-related use of the platform.

Any events, meetups, track days, cruises, or other activities listed on Club pages are organized solely by third parties. Qualy does not organize, host, sponsor, or endorse any such activities and provides listings strictly as informational, user-generated content.

All Clubs, organizers, and participants are solely responsible for ensuring that any events or activities are legal and compliant with all applicable laws, regulations, and venue rules. Use of the platform to promote or facilitate illegal activity is strictly prohibited.

Participation in any Club-related activity is entirely at your own risk. Qualy is not responsible for any injuries, damages, losses, or incidents arising from such activities or from the conduct of any participants.

Club leaderboards and competition features remain subject to all Qualy competition rules. Qualy reserves the right to review, reject, or disqualify laps for unsafe or unsportsmanlike behavior.

Qualy functions solely as a digital platform for competition and content display and is not an event organizer or intermediary for real-world activities.
